On Tuesday January 17th (from noon to 1:30 pm) the MMLA will sponsor a virtual program for its members with DHCD representatives to discuss legal issues related to “Section 3A” compliance in connection with the multi-family zoning requirement for MBTA Communities. This will be an opportunity for DHCD to engage with municipal counsel on legal (rather than technical) questions related to the zoning mandate and consequences of noncompliance.
MMLA Executive Board member Susan Murphy of Dain, Torpy, Le Ray, Wiest & Garner, P.C. will moderate a discussion by DHCD representatives, with a focus on the Action Plan each MBTA community is required to file with DHCD by January 31, 2023 in order to remain in compliance. DHCD will also provide an overview of the “Compliance Model” User Guide that was recently shared with communities, available here.
Members are invited to share in advance any legal questions you have, or the communities you represent may have posed to you, so that DHCD has an opportunity to review the questions and respond during their presentation.
